General Conditions The below terms and conditions apply to, and are printed on all HOWZAT membership applications. Please feel free to contact us if you have any queries or questions. Membership entitles the bearer to full use of all facilities in the Health Club, including gym equipment group fitness classes, lockers, amenities and sauna, fitness assessments and gym programming throughout opening hours. When using the health club a member must comply with the rules set down by HOWZAT. HOWZAT reserves the right to amend the rules at any time and refuse admission or ask a member to leave to ensure the effective operation of the club. A member must... 1) Not abuse the equipment or facilities of HOWZAT. Any wilful, negligent or deliberate damage to HOWZAT property must be paid for by the member. 2) Not behave in a disorderly, violent or offensive manner which causes or is likely to cause offence, distress, or annoyance to other members or employees of HOWZAT. 3) Not smoke in any part of the club. 4) Not bring alcohol or intoxicating liquor, narcotics, steroids or other illegal substances into HOWZAT. 5) Complete a Pre-Activity Questionaire provided by HOWZAT prior to my first workout and ensure to update this information if my health and mental well being changes. I warrant I am physically and mentally sound to proceed with a normal course of exercise. All memberships include GST and your membership receipt is your Tax Invoice. Minimum dress for a workout is shorts, T-shirt or singlet which cover the chest area and enclosed shoes. A sweat towel must be used throughout each workout or class. They are available for hire from HOWZAT Health Club Reception. Lost, damaged or stolen cards, a small $2.50 replacement fee applies. All memberships have a joining fee which expires prior to your renewal. Once membership is lapsed, the joining fee will apply. 20 visit passes have a 6 month validity and can only be used by one person - who signed the membership agreement. Personal Training can only be conducted by HOWZAT Personal Trainers. Membership Conditions · I agree and abide by the policies and guidelines (above) set by HOWZAT Newcastle in relation to the use of its facilities. I will conduct myself appropriately and follow reasonable directions of HOWZAT Newcastle and its Team whilst I am on or about the premises. · I acknowledge that if I fail to comply with any such policies or directions or otherwise engage in behaviour which is offensive or disruptive to HOWZAT Newcastle or other members, I may be asked to leave the premises, forcibly removed if necessary and / or have my membership cancelled. In such case no refund of membership will be paid. · I am aware that use of the premises and its facilities and my participation in the classes and programs conducted by HOWZAT Newcastle may involve strenuous activity and special risk (special or otherwise) associated with such use and participation and I release HOWZAT Newcastle and its directors, employees, contractors and agents from all liability and responsibility whatsoever, for personal injury, property damage, loss or death howsoever caused including, but not limited to the negligence (whether passive or active) of HOWZAT Newcastle or its Team or any other person using the premises. Corporate Conditions
Refunds A refund may be issued for the unused portion of a Membership only if a medical condition prevents the Member using the Club’s facilities and services. A medical Certificate must be supplied with the refund application. HOWZAT memberships have a 7 day cooling off period, commencing on the enrolment date, during which time the member may terminate the membership. This does not apply to multi visit passes. Refunds will be paid within 14 days. Timestop Timestop will be issued for a minimum of 1 month and maximum of 3 consecutive months within any 12 month membership term. Timestop does not accumulate across membership terms and is only offered in monthly blocks. Timestop will only be issued: 1) Upon completion of a timestop application form upon commencement of the Timestop period. 2) Written notification is required. If it is for medical reasons a doctor’s certificate is required. Extended periods (3-6months) may be issued for medical reasons. 3) Payment of a $12.50 Timestop fee will apply per timestop, upon commencement of timestop. 4) Your membership card needs to be held a HOWZAT throughout your timestop Timestop will not be issued after the event or absence from the HOWZAT . Timestop is not transferable to other members.
If your current membership expires whilst on Timestop, the frozen time
will automatically be added to your initial Transfer · All memberships are transferable to other non members. · A Transfer fee will apply to the new member starting. · All transfers will be required to complete a new membership application · Visit passes transfers do not entail the transfer fee, however still do need to complete a membership application. Children
All children under the age of 12 years must attend childminding unless in
a club approved program (ie: Junior Members must comply with the rules and guidelines outlined for the Child minding service. Persons must be over the age of fourteen (14) to enter this Health Club. Health Club members or guests who are age fourteen (14) are permitted to participate in non-weight bearing activities. Only when the member or guest are aged sixteen (16) or more may they participate in weight bearing activities. Complaints All HOWZAT Team members are available to hear your feedback, alternatively feedback boxes have been placed throughout the club if you prefer to document your feedback. Where written feedback is provided, HOWZAT will 1) Provide the complainant with
written feedback within 10 days of receiving the complaint and
outline the course of 2) If the complaint can not be resolved within the 10 days, HOWZAT will provide written feedback within 10 days of receiving the complaint and specify the time frame within which the complaint will be addressed and a possible result taken. Department of Fair Trading The NSW Fitness Services (Pre-paid Fees) Act 2000 spells out how HOWZAT Newcastle must deal with the pre-paid fees members make for its services and facility. 1) HOWZAT Newcastle can not except pre-paid fees providing a fitness service that extends beyond a 12 month contract. 2) HOWZAT Newcastle must give all members the option of choosing a membership based on a monthly billing agreement. 3) HOWZAT Newcastle is prohibited from accepting pre-paid fees for periods that exceed the unexpired portion of their lease, unless they advise members in writing of the date on which the lease is to expire.
